HOLLYWOOD, Calif. — Former Blink-182 member Travis Barker is suing Rockstar, accusing the energy drink company of wrongfully using his likeness.
The lawsuit claims that the Rockstar Web site published a photo of Barker "holding a can of one of Rockstar's beverages, and identifying him and his endorsement by name" without his consent.
The Superior Court lawsuit claims invasion of privacy, unfair competition and misappropriating the drummer's likeness to promote the product.
Barker, who now drums for the band +44, is "a prominent figure in the rock music world," according to the lawsuit, which is seeking to recover unspecified punitive and statutory damages.
On its Web site, the company says it sells energy drinks for people "from athletes to rock stars."
Barker's career took off when he joined up with the punk rock band Blink-182 in 1998. Barker became known for his mohawk and his tendency to perform without a shirt, revealing a multitude of tattoos.
