HOLLYWOOD, Calif. — Claiming that she felt "intimidated," Kelly Rutherford reportedly called the police twice on her estranged husband Daniel Giersch, according to court documents obtained by People.
Rutherford, who filed for divorce on Dec. 30 despite being four months pregnant with the sparring couple's second child, refers to Giersch as "an avid boxer and a kickboxer, and I am intimidated by him," in the court papers filed on Jan. 16. Rutherford and Giersch have been battling over their 2-year-old son, Hermes.
The first call to the police happened while the pair was staying at the Wales Hotel in New York.
"[He] kept yelling at me in front of Hermes, and threatening that he was going to take Hermes," claimed Rutherford, according to the mag. "[He] kept saying that I was 'going to learn,' and that he was 'going to teach [me] a lesson.' "
A second call to the police came about a short while later in Los Angeles. Rutherford claims her husband "cornered [her] and came within inches of [her] face."
"He would not back away," she argues in the filing.
"I was crying and [he] was yelling at me," the papers continued. "I remember [him] again saying that I was 'going to learn' and he was again threatening to take Hermes away.' "
In both disturbances, Giersch, a 34-year-old German businessman, was asked to leave by authorities and no arrests were made, according to the documents.
In a statement to People through his attorney, Giersch denied any wrongdoing on his part.
"I don't want to comment because all of these accusations from Kelly are false and are intended to damage my reputation," he said. "I am solely seeking what is in our children's best interest."
A rep for the "Gossip Girl" star responded by telling the mag: "Kelly is focusing on what is in the best interest of her family and trying to bring as much normalcy to their lives as possible during this difficult time. The statements being made by her husband Daniel Giersch are completely fabricated and Kelly is a loving and caring individual and a wonderful mother."
Rutherford and Giersch welcomed Hermes in Oct. 2006, two months after they tied the knot.
