HOLLYWOOD, Calif. — Kelly Rutherford was granted a temporary restraining order Thursday against her estranged husband Daniel Giersch, according to court documents obtained by People.
The 40-year-old actress claims the German entrepreneur has repeatedly harassed her and her family, including her mother and her nanny, the documents filed at Los Angeles Superior Court state.
The order will remain in effect for 21 days pending a court date to hear evidence.
Giersch's lawyer has denied Rutherford's claims, calling them "fabricated accusations" meant to harm her estranged husband's reputation.
"Daniel will remain focused on co-parenting both of their children and not make any personal comments in order to continue to protect the children's need for privacy and well being," said attorney Fahi Takesh Hallin.
The "Gossip Girl" star filed for divorce on Dec. 30, despite being four months pregnant at the time. She and Giersch are currently locked in an ongoing custody battle over their son, Hermes, 2, and daughter, Helena, 3 months.
A hearing on the matter is scheduled for Oct. 15.
