HOLLYWOOD, Calif. — Kathleen Firrantello, the daughter of late jazz musician Joe Farrell, has filed a lawsuit against rappers Kanye West, Method Man, Redman, Common and their record companies, alleging they used her father's music without permission.
Firrantello filed the suit Thursday in the U.S. District Court in New York. She claims the rappers used samples of Farrell's 1974 song, "Upon This Rock," in three different tracks — "Gone" by West, "Chi-City" by Common, and "Run 4 Cover" by Method Man and Redman.
Firrantello is seeking more than $1 million in punitive damages. She has also demanded that further copies of the tracks not be made, performed or distributed.
Reps for the rappers and their respective record labels did not immediately comment.
Farrell, real name Joseph Firrantello, passed away in Los Angeles in 1986. During the 1960's, he played with the Thad Jones/Mel Lewis Big Band. He is best known for playing alongside Chick Corea in the jazz fusion band Return to Forever in the early 70's.
