HOLLYWOOD, Calif. — Halle Berry is gearing up for a bitter custody battle for her 2-year-old daughter Nahla.
The Oscar-winning star has quit her role in New Year's Eve, a movie scheduled to begin shooting in New York this week, her rep revealed Monday to People magazine.
"Halle has serious concerns for her daughter's well-being while in the care of her father for any extended period of time and is prepared to take all necessary steps to protect her," her rep told the mag.
The father of the child is Berry's ex-boyfriend, Gabriel Aubry. In late December, the Canadian model filed legal documents asking for joint physical and legal custody of Nahla, who turns 3 in March.
The rep said Berry had attempted to resolve custody issues with Aubry "amicably," but "given his lack of cooperation, she had "no choice but to seek swift judicial intervention."
Berry, 44, and Aubry, 35, split last April after four years of dating. Her rep noted the actress has "acted in her daughter's best interest" – both before and after their breakup.
